A group of lawmakers from both the House and Senate is demanding answers from the Department of Justice (DOJ) on its actions to prevent noncitizens from voting in federal elections, citing concerns about the integrity of U.S. elections.
Led by Senator Bill Hagerty (R-TN) and Representative Andy Biggs (R-AZ), 73 lawmakers sent a letter to Attorney General Merrick Garland, expressing their frustration at the DOJ’s lack of response to an earlier inquiry made in July.
The letter highlights their “deep concern” over reports that noncitizens have managed to register and even vote in federal elections. These concerns are particularly pressing, as the 2024 Presidential Election is fast approaching.

The lawmakers noted that with the election just over a month away, the DOJ’s failure to address their questions or take visible action is “especially alarming.”
The letter specifically demands answers regarding how many noncitizens have been prosecuted for illegal voting, how the DOJ handles such allegations, and what preventive measures are in place. This inquiry comes amid broader concerns about the influx of immigrants and the potential for noncitizens to vote unlawfully.
Republicans, including former President Trump, have frequently raised the issue of illegal voting by noncitizens, particularly in light of the ongoing border crisis.
In response, GOP lawmakers have introduced the SAVE Act, which would require proof of citizenship in person when registering to vote and mandate the removal of noncitizens from voter rolls.
The letter references recent cases in Virginia and Texas, where thousands of noncitizens were found on voter rolls.
In Virginia, over 6,000 noncitizens were identified on the rolls between 2022 and 2023, while Texas removed 6,500, with nearly 2,000 having a history of voting.
Additionally, the DOJ recently charged an illegal immigrant for using stolen U.S. citizen identity to vote in multiple elections.

Lawmakers argue that even a small number of noncitizens voting poses a serious threat to election integrity, potentially undermining public trust in the democratic process. They also point out that the DOJ’s lack of response raises concerns about whether the department is fulfilling its responsibility to uphold laws that prevent illegal voting.
As reported by Fox News, the DOJ has yet to respond to the lawmakers’ July inquiry, despite the upcoming election. Meanwhile, the DOJ has been busy pursuing lawsuits, including one against Alabama, accusing the state of improperly removing voters with noncitizen identification numbers from its rolls too close to Election Day.
The DOJ claims this violates the National Voter Registration Act of 1993, which requires states to finalize voter list changes no less than 90 days before a federal election.
